Today’s episode is a bit longer than usual because I’m hoping to cover two recent legal decisions in one episode. Please bear with me.
On March 18, two legal decisions came down that went badly for those of us who care about the material reality of sex. One was from a state appellate court in Ohio, and the other was from a federal district court in the District of Columbia. The ruling out of the state appellate court in Ohio is bad, and the ruling out of the federal district court in DC is worse. But the underlying reason that both are bad is that in each, the court assumed that trans is real. One reason each court assumed trans is real is that the government lawyers involved didn’t tell them that it isn’t. As Glenna Goldis recently said on X, go big or go home!
