WDI USA Files Brief in Olympus Spa v. Armstrong
Plus some thoughts on the National Organization for Women and an interview with Peter Boghossian

WDI USA has filed a friend of the court brief (which you can download and read here) in a case called Olympus Spa, et al. v. Armstrong, et al. At issue in the case is the ability of a female-only nude spa to exclude men. A man named Haven Wilvich had been excluded from the spa (which has a clear women-only policy) and brought the spa before the Washington State Human Rights Commission. He won, and the spa fought back by filing a federal lawsuit. In its order dismissing the spa’s complaint, the District Court for the Western District of Washington repeatedly used the phrase “transgender women with male genitalia” uncritically and without explanation. The case is now before the Ninth Circuit Court of Appeals. As we say in our brief,
It is truly a testament to where we are as a society today that it must be said in the context of federal civil rights litigation that women don’t have penises.
While I was working on that section of the brief, I found myself staring at that text for a while, shaking my head, and then having to go for a long walk. If you had told me when I graduated from law school that I would one day be using my law degree to explain to the federal judiciary that women don’t have penises, I would not have believed you.
A few days ago, the National Organization for Women posted on X that Riley Gaines and other female athletes who fight for women-only sports are supporting the white supremacist patriarchy and I called them a “complete and utter embarrassment.” That was not my finest moment, I realize, but check out the ratio on the exchange.
That screenshot was taken at around 3:15 today. After four days, NOW’s post has fewer than 800 likes to its 2.7 million views. My reply has over five thousand likes to its 58.3 thousand views. Apparently quite a few people agree with me about NOW being a complete and utter embarrassment, and they ended up turning off replies. To my surprise, my reply showed up in an outstanding Daily Mail article about the story. So NOW did the only thing sensible and mature adults can do under such circumstances: they blocked me.
On the topic of whether the fight to protect women’s sex-based rights amounts to supporting white supremacist patriarchy, please check out WDI USA’s Black Women’s Caucus’s Statement Against Gender Ideology, which explains that:
Gender ideologues employ the “forced-teaming” tactic against Black women in order to shame us into being work mules for their campaign of male sexual privileges that they call “transgender rights.” While these efforts are masked as progressive and inclusive concepts, gender identity ideology is actually intrusive and harmful to women, and uniquely so to Black women.
In other words, it’s gender ideologues who are supporting the white supremacist patriarchy, not Black radical feminists.
NOW still sends me fundraising mailers. For the past several years, when I have gotten such a fundraising mailer from them, I have returned it covered in “Woman = Adult Human Female” stickers. I have no idea why they don’t remove me from their mailing list. The next time I get one, I’m going to take a sharpie to it and write, “YOU BLOCKED ME ON TWITTER AND A WOMAN IS STILL AN ADULT HUMAN FEMALE, YOU IDIOTS.” Maybe that will do it.

Oh, I don't know, Kara, I think it was a damn fine moment, succinct and true, as is your way. The ratio does not lie. What the hell is wrong with those women? Keeping men out of women's sports is an expression of white supremacist patriarchy? You'd have to be in a sleep-deprived delusional state to come up with something so illogical and just plain dumb. If they're so concerned about racism, they should ponder WDI USA's Black Women's Caucus Statement Against Gender Ideology until common sense sinks in.
Also, by throwing women under the bus, the NOW contingent insulted their own organization and the memory of one of our greatest African American lesbian attorneys, the brilliant Pauli Murray, a founder of NOW and co-author of its Statement of Purpose with Betty Friedan in 1966.
No need to apologize since NOW is a complete and utter embarrassment.
