On May 3, WDI USA filed an amicus brief before the U.S. Court of Appeals for the Fourth Circuit in the case of BPJ v. West Virginia. In this case, West Virginia has a law on the books mandating that school sports remain single-sex. BPJ is a young man who wants to compete on the girls’ cross-country team on the basis of his “gender identity” and he sued the state to be able to do that.
At the federal District Court level, the court ruled in favor of the state – that under both Title IX and the Equal Protection Clause of the Constitution, states may maintain single-sex sports in schools.
WDI USA is urging the Fourth Circuit to affirm that decision on appeal.
