On April 26, the Department of Justice announced that it is suing the state of Tennessee. The lawsuit concerns Tennessee’s SB 1, which “prohibits a healthcare provider from performing on a minor or administering to a minor a medical procedure if the performance or administration of the procedure is for the purpose of enabling a minor to identify with, or live as, a purported identity inconsistent with the minor’s sex” and is scheduled to take effect on July 1.

The crux of the Department’s argument is that the law “denies necessary medical care to youth based solely on who they are,” and that this violates the Equal Protection Clause of the 14th Amendment.
