On December 15, 2023, female athletes won a major victory in the 2nd Circuit Court of Appeals when the court reinstated the case of four female athletes—Selina Soule, Chelsea Mitchell, Alanna Smith, and Ashley Nicoletti—who had lost out on opportunities due to the policy of the Connecticut Interscholastic Athletic Conference (CIAC) allowing male athletes to compete in girls’ athletic events on the basis of their “gender identities.” The case is Soule v. CIAC. The 2nd Circuit’s recent decision is the latest development in the case, but it won’t be the last, and the case has a long way to go.
Incidentally, this case could go away if the Democrats in the U.S. Senate would act to pass the Protection of Women and Girls in Sports Act, which the House of Representatives passed in April. I explained why progressives should support this strong piece of legislation here and the US chapter of Women’s Declaration International is urging people to show their support for the bill by telling their Senators to advance it here. Anyone is welcome to tell the Senate to advance the bill, potentially avoiding the need for further costly litigation in the Soule case.
