A decision was announced in the case of B.P.J. v. West Virginia State Board of Education yesterday. The central holding is that it is permissible for a state to define the words “girl” and “woman” as biologically female. I have not been able to find the opinion online, but I was able to download it as a pdf from a federal database that maintains court documents and makes them available for download by those with accounts. The opinion is dated January 5, 2023 and begins like this:
